PRODUCT INFO | Transferring judgments from countries outside the United Kingdom is made easy using Shergroup’s website and hub facility where all enquiries are processed by our fulfilment team.
As the UK has now left the European Union as of 31st December 2020, we offer our service to review and guide on the enforcement of all European judgments and orders. As with judgments from other parts of the world, you can send any judgment or order to us for a free review using our email of firstname.lastname@example.org. We can then guide you on what can be done to enforce your judgment or order in the 4 nations of the United Kingdom being England, Wales, Scotland and Northern Ireland before you pay any fee.
Once we have reviewed your paperwork, we will ask you to submit your instruction via our website and pay our fixed fee to manage the transfer of your judgment or order.
Please note additional fees may be payable in Scotland and Northern Ireland for court fees, enforcement office fees, and Sheriff’s Officers. A proforma invoice will be issued for these fees as soon as they are known and are outside the scope of our fixed fee service. We will be able to guide you on what the cost will be when we receive your judgment or order for review.
As part of our fixed fee service, we will |
- Identify/verify the current address of your Judgment Debtor
- Look at the background to the judgment
- Check businesses to see they are still trading and the organisation’s structure – i.e. company, partnership, sole trader
- Check individuals for an address and location - enforcement against an individual (including a sole trader) involves checking the address and asking you to share with us as much background information as possible about your Judgment Debtor
If your judgment or order, including European Enforcement Order/European Payment Order, is not in English, we will ask you to provide a Certified Translation of the wording into English. If you get stuck on this part of the process, we can help you obtain the right form of translation. There will however be an extra cost for the translation service.
We will ask you to confirm if your Judgment Debtor has admitted your claim, agreed on a settlement or filed a defence at any point in the proceedings that resulted in your judgment or order being made.
The result of all this activity is that you will be certain you have an enforceable judgment in the United Kingdom or confirmation that the judgment/order you have is not going to be recognized in the United Kingdom.
Where the value of your judgment or order is over £600, we recommend using a Writ of Control as your first step to enforce your judgment in England and Wales. In Scotland, the procedure is similar, and Sheriff’s Officers can be instructed to do virtually the same process. There will be additional statutory fees charged by the Sheriff’s Officers. In Northern Ireland, we will manage the transfer through the Enforcement of Judgments Office. Again, additional statutory fees will be charged.
